This Privacy Policy discloses the privacy practices for the hope movement site and various related services provided through this website any sub-domains thereof, API integrations or widgets we offer, any email, messaging, applications, or any of the services or features accessible therein, and any other website or web pages we own or operate that include a link to this statement (together referred to as the “site”). hope movement, the provider of the site (referred to as “our,” “us,” or “we”), is committed to protecting your privacy online. Please read the information below to learn the following regarding your use of this site.

All personal data that is collected and used will be processed in compliance with the General Data Protection Regulation and other EU and Swiss data protection requirements for the European Economic Area (“EEA”). Users from the EEA please review the sections for EEA users below.

We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, issuing an email to the email address listed by registered users and posting the revised Policy on this page. You acknowledge and agree that it is your responsibility to maintain a valid email address as a registered user, review this site and this Policy periodically, and to be aware of any modifications. You agree to abide and be bound by this Privacy Policy and subsequent modifications to the Policy, until such a time as you submit a request to remove your information according to Section 4 of this Policy.

If you are registering for or participating in a sweepstakes, event, contest, drawing, or other contest (the “Contest”) participation is subject to our Official Rules and Regulations of that Contest and any other rules and regulations applicable to such Contest (collectively, “Rules”). If this Privacy Policy conflicts with or is inconsistent with a statement in the Rules concerning your privacy, the Rules will apply.

1. Types of Information Collected

In order to better provide you with our numerous services, we collect two types of information about our users: Personal Data and General Data. Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using our site.

Personal Data: This refers to data that lets us know the specifics of who you are. When you engage in certain activities on this site, such as registering for a membership, ordering a product or service, submitting content and/or posting content in public areas, entering a sweepstakes or contest, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself, by filling out and submitting an online form. It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including zip code), email address, employer, job title and department, telephone and facsimile numbers, and other personal identifying information. When making donations, or ordering products or services on the site, you may be asked to provide a credit card number. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

General Data: This refers to data that does not by itself identify a specific individual. We may gather certain information about you based upon where you visit on our site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Web site’s Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address. A URL is the global address of documents and other

resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet. We may also gather information regarding the specific device, computer, hardware, software you are using, and data obtained from cookies as described in more detail below.

2. Collection Methods and Use of Information

We do not collect any Personal Data about you unless you voluntarily provide it to us or our customer. You provide certain Personal Data to us or our customer when you: (a) register for our services and register your email address with us; (b) enter sweepstakes or contests sponsored by one of our customers; (c) sign up for special offers from selected third parties; (d) send email messages, submit forms or transmit other information by telephone or letter; or (e) submit your credit card or other payment information when ordering and purchasing products and services on our site or an affiliated third party website used for payment processing. We may also collect information from you at other points on our site that state that such information is being collected. If you are located in the EEA, we will only send you marketing information if you consent to us doing so at the time you create your account or any point thereafter.

We will use, process, and store information as necessary to perform our contract with you and for our legitimate business interests, including the use of your Personal Data to provide our services to you, as required by our agreements with you. We will also use Personal Data to enhance the operation and administration of our site and the services that we provide to affiliated partner websites in the operation of sweepstakes, or in order to fill orders, improve our usability, features, security, operation, transactions, marketing, and promotional efforts, or to statistically analyze site use, improve our product and service offerings, and customize our site’s content, layout, algorithms, and services. We may use Personal Data to deliver information to you and to contact you regarding administrative notices, from which you can unsubscribe at any time. We may also use Personal Data to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Privacy Policy.

3. Release of Information

Except as otherwise provided in this Privacy Policy, we will keep your Personal Data private and only share it with other third parties when:

  • (i)  Service Providers. We use service providers who assist us in meeting business operations needs, including hosting, delivering, and improving our services. For more information see the section on, “Who Has Access to my client’s Personal Data below.” We also use service providers for specific services and functions, including email communication, customer support services, and analytics. These service providers may only access, process, or store Personal Data pursuant to our instructions and to perform their duties to us.

  • (ii)  Consent. We have your explicit consent to share your Personal Data.

  • (iii)  Law Enforcement. Occasionally we may be required by law enforcement or judicial authorities to provide Personal Data to the appropriate governmental authorities. We will disclose Personal Data upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

  • (iv)  Safety. We determine that the access, preservation, or disclosure of your Personal Data is required by law to protect the rights, property, or personal safety of hope movement and users of our Site, or to respond to lawful requests by public authorities, including national security or law enforcement requests.

  • (v)  Business Transaction. We need to do so in connection with a merger, acquisition, bankruptcy, reorganization, sale of some or all of our assets or stock, public offering of securities, or steps in consideration of such activities (e.g., due diligence). In these cases some or all of your Personal Data may be shared with or transferred to another entity, subject to this Privacy Policy.

Marketing Companies. We may provide general location data (e.g., the city, or the state, in which a device is located) and information about your search or posting history to third parties that want to provide you with information, products, or services. Unless we have your permission, we will only provide such companies with non-personally identifiable information. In other words, while this information may be provided in conjunction with a randomly assigned number, or a number assigned to your hope movement account, it will not be provided in conjunction with your name.

With a Charity or Prize Provider. If you enter a sweepstakes, whether by making a donation or using an alternate method of entry, make a donation in connection with entering into a sweepstakes, you agree that we may share your name and contact information with the charity we designate as the benefiting charity for such sweepstakes and with any entity providing prizes for that sweepstakes, who may use your information for marketing purposes.

Sweepstakes Winners. As further explained in our Rules, by entering into a sweepstakes, you grant us the right to disclose name, biographical information, pictures/portraits, video images, likenesses and/or voice to the general public if you are a sweepstakes winner.

  

We will encourage our customers and service partners to adopt and post privacy policies. However, the use of your Personal Data by our customers and service partners is governed by the privacy policies of those customers and service partners, and is not subject to our control.

4. Updating. Correcting, and Deleting Data

It’s up to you whether or not you want to provide us with Personal Data. You can still visit the Site without providing us with Personal Data, but you will be unable to take certain actions without doing so.

We believe you should have the ability to edit the Personally Data that you have provided to us. You may change any of your personal information by contacting us at info@hope movement.com.

Please include the name, address, and/or email address you used when you originally registered when you contact us so that we can identify your existing registration.

We encourage you to promptly update your Personal Data if it changes. You may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on this site. In addition, it may be impossible to completely delete your information without some residual information because of backups.

5. User Choices on Collection and Use of Information

We may, from time to time, send you email or direct mail regarding our products and services. Marketing Emails contain an unsubscribe option which you can follow at any point if you wish to stop receiving some or all of the Marketing Emails. If you have received our Marketing Emails mistakenly, or wish to stop receiving them, you can also contact us at info@hope movement.com and we will remove you from our list.

Our customers, partners and affiliated websites may also send you direct mailings if you register through our services. If you do not want to receive mailings from our customers, partner and affiliated websites you must contact them directly.

You also have choices with respect to cookies, as described below. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our site may not work properly in your case.

We will retain your information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

For EEA users: We only send marketing communications to users located in the EEA with your prior consent. Please see the section “For EEA users” below.

6. Security of Information

At our site you can be assured that your Personal Data is secure, consistent with current industry standards. The importance of security for all Personal Data associated with our user is of utmost concern

to us. Your Personal Data is protected in several ways. Your Personal Data resides on a secure server that only selected personnel and contractors have access to via password. We encrypt your Personal Data when it is transmitted to us and thereby prevent unauthorized parties from viewing such information.

Personal information that you provide that is not Personal Data also resides on a secure server and is only accessible by selected personnel and contractors via password.

In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third party banking, processing agents and distribution institutions. They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order. In addition our customer who is sponsoring the sweepstakes, fundraising, or other associated event through our services receives the information needed to process their transaction and operate their fundraising services.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Data, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

If hope movement learns of a security system breach, we may attempt to notify you and provide information on protective steps, if available, through the email address that you have provided to us or by posting a notice on the Site. Depending on where you live, you may have a legal right to receive such notices in writing.

7. Cookies

When you use our site we may store cookies on your computer in order to facilitate and customize your use of our site. A cookie is a small data text file, which a Web site stores on your computer’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us. Our cookies store randomly assigned user identification numbers. The cookies make your use of the site easier, make the site run more smoothly and help us to maintain a secure site. We also use cookies to serve ads through third-party ad- network services to people who have visited our site (“Retargeting Ads”). These Retargeting Ads will be viewable on other websites that are part of the ad network. You are always free to decline our cookies if your browser permits, but some parts of our site may not work properly in that case. We may also provide our service through a third party or outside website. As part of their service, they will place a separate cookie on your computer, based on the third party website’s Privacy Policy.

8. Privacy Policies of Third Party Sites

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other sites accessible through our site have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy. We are not responsible for the policies or practices of third parties.

9. For EEA Users

This Privacy Policy is intended to provide adequate and consistent safeguards for the handling of personal information hope movement uses, processes, and stores Personal Data, including those listed in the “Types of Information Collected” section, as necessary to perform our contract with you, and based on our legitimate interests in order to provide the website services. We rely on your clear and unequivocal consent for the processing, collection and transfer of Personal Data. Personal Data may be used to send promotional emails and to place cookies on your devices. In some cases, hope movement may process Personal Data pursuant to legal obligation or to protect your vital interests or those of another person.

10. Rights of EEA Users

Individuals located in the EEA have certain rights in respect to their personal information, including the right to access, correct, or delete Personal Data we process through your use of the website. If you’re a user based in the EEA, you can:

(i) Request a Personal Data report by submitting an email to info@hopefitnessmovement.com. This report will include the Personal Data we have about you, provided to you in a structured, commonly used, and portable format. Please note that hope movement may request additional information from you to verify your identity before we disclose any information.

  • (ii)  Have your Personal Data corrected or deleted.

  • (iii)  Object to us processing your Personal Data. You can ask us to stop using your Personal Data, including when we use your Personal Data to send you marketing emails. We only send marketing communications to users located in the EEA with your prior consent, and you may withdraw your consent at any time by clicking the “unsubscribe” link found within hope movement emails and changing your contact preferences. Please note you will continue to receive transactional messages related to our services, even if you unsubscribe from marketing emails.

  • (iv)  Complain to a regulator. If you’re based in the EEA and think that we haven’t complied with data protection laws, you have a right to lodge a complaint with your local supervisory authority.

11. Miscellaneous Privacy Issues

You must be at least 18 years old to have our permission to use this site. Our policy is that we do not knowingly collect, use or disclose Personal Data about visitors that are under 18 years of age. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children never to provide personal information through the Site without their permission.

You should also be aware that when Personal Data is voluntarily disclosed (i.e. your name, email address, etc.) in the discussion forums or other public areas on this site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Policy does not apply to such information. Any submissions to chat rooms or other public areas on this site are accepted with the understanding that they are accessible to all third parties. If you do not want your comments to be viewed by third parties, you are advised not to make any submissions.
